Boonville Area Farmers’ Market

 

Rules & Regulations

 

Effective:  April 1, 2011

 

The Boonville Farmers’ Market is established for the expressed purpose of enabling local farmers and gardeners to augment their sales of surplus vegetables, fruits, baked goods, and homemade handcrafted items. 

 

ELIGIBILITY:  To be eligible, an applicant must be a resident of Oneida or Lewis County.  The vendor must be the actual producer of 2/3 of their produce which is grown in these counties with some limited exceptions.  It is suggested that locally grown produce be labeled as such.  According to FMNP guidelines put forth by the Ag and Markets (NYSDAM), those vendors who participate in the Farmers’ Market Nutrition Program must produce/grow at least 50% of the produce that is brought to the market, unless the particular farmers’ market has higher requirements.

 

  1. All applicants must pre-apply to the Farmers’ Market Committee for permission to set up in the market area.  Applications can be picked up at Boonville Village Offices, Boonville, NY (335-9851).  Or email a request to: boonvillefarmersmarket@yahoo.com 
  2. No one will be admitted to the market unless they have prior approval.  New applicants will have a 3 week probation period before final acceptance to the market.
  3. The applicant must be prepared for sale:  farm products, plants, flowers, or such articles of a handmade variety normally classified as home baked goods, homemade crafts. 
  4. The applicant must agree to abide by all the rules of the market, including any regulations promulgated by the state or local authorities concerning sanitation, health, or other reasons.  Signing the application means acceptance of these rules. 
  5. The market will operate every Thursday beginning June 16th and ending October 12th.  The hours of operation will be 12noon to 6pm.
  6. There will be no rain dates.  The market operates “rain or shine”.  As is the market is an open-air market, vendors are responsible for providing their own appropriate sun/rain shelter.
  7. The site of the market will be along the canal, behind Nice ‘N Easy, just off Main Street.
  8. The market will receive vendors beginning at 10:00 am, at which time the market manager will direct vendors to their designated locations. 
  9. In the event that you are going to miss a particular Thursday market, you are asked to let the manager know ahead of time, so that your designated spot may be given to another vendor for that day.
  10. Each vendor location in the market area should not exceed Ten (10) feet in front footage.        
  11. Only one (1) vehicle may be brought in to the market and must be attended at all times.  We reserve the right to limit the size of vehicles.
  12. Only one (1) space will be assigned to a participant or farm family unless more space is deemed necessary and/or is available.  An additional fee is required for additional space used. 
  13. Vendors, realizing a shortage of their product, may restock during market times.
  14. Each participant must be identified with a sign.  The sign must state the name and address of the participant.  This sign must be visible to market customers.  Product prices must also be visible to market customers. 
  15.  A small fee - $5.00 will be collected each week in order to cover the cost of using the facilities and for market promotions. This fee will be collected at the beginning of he day.  Pre-paid seasonal spots are available at a reduced rate of $80.00.  This must be  paid in full prior to the first week of the market o
  16. Vendors with guaranteed spots must arrive by 11:30am, otherwise the spot will be resold to another vendor.   If you must miss a week, please notify the Market Committee, in advance, that you will not be attending and your spot will be reassigned for that specific week.
  17. Sales tax must be collected and reported by the participant for all items sold that are subject to sales tax.  Vendor sales tax certificates must be in view at all times. 
  18. Crafters must submit a description of handcrafted items that will be offered for sale.  No manufactured items are allowed.  Crafts and non-agricultural products are limited to those that are made and/or representative of the region.  Non-agricultural products must be pre-approved by the Market Committee.
  19. Participants are expected to keep their area clean during the day.  When leaving the area, vendors must make sure their areas are clean and free of all trash and/or oil spills. 
  20. If participants use any available picnic tables or benches, they must return these to their original location.
  21. No individual amplifiers or other sound devices are to be used. The market staff will provide music for the market.
  22. Children under 12 must be supervised.  No animals are allowed.
  23. Participants will comply with all regulations under the Department of Agriculture and Markets, Division of Farm Product Services.  Anyone selling plants at the market must follow guidelines set forth by NYSDAM.  No one will be permitted to sell outdoor plants without an NYSDAM grower’s permit.
  24. NYSDAM approved baked goods must be either wrapped or inserted in “see through” materials.  All baked or prepared foods must be covered and protected from wind-borne dust and insects.  All baked goods must have labels listing all information as required by the NYSDAM.
  25. All scales to be used for weighing purposes must be certified annually by Weights and Measures.
  26. Only new bags may be used for customer purchases.
  27. Participants shall not use obscene language or participate under the use of alcoholic beverages or drugs.  Disorderly conduct, unruly behavior, or any behavior disruptive to others will not be tolerated.  Vendors will dress appropriately. 
  28. No hawking of wares is allowed.  Vendors are not allowed to aggressively badger potential customers. 
  29. The market reserves the right to limit the number of crafters selling their goods at the market.  This is done in order to maintain the appropriate proportion of produce and crafters with the goal of keeping the free spirit of farmers at our market.
  30. Failure to abide by the market rules will result in being denied the privilege of participating in the market.  Vendors who violate market rules will receive a written warning for each infraction.  After the third violation, market members may prohibit the violator from future markets.
  31. Any vendor with a complaint against another vendor must put it in writing and sign it.  The market board will review the complaint and provide guidance to correct the situation.
  32. All of the market members are responsible for their market and will supervise the market during the hours of operation.  The market review board will approve new applicants.
  33. While certificates of insurance are not required at this point, vendors are strongly advised to secure liability market insurance coverage from your private carrier.
